The change of condition application seeks approval to increase the consented capacity of the childcare centre from 50 to 80 children, extend the consented hours of operation by an additional 30 minutes, undertake internal reconfiguration of the childcare centre’s building, and revise the on-site parking layout. As a result, several conditions of the original land use consent will need to be amended to reflect the updated development plan.

The proposed change of conditions would not result in a fundamentally different activity or one having materially different adverse effects. Therefore, it is appropriate that the proposal be considered pursuant to Section 127 of the RMA and not as an entirely new resource consent application.

According to the transportation assessment report submitted as part of the application, any adverse effects to the function, capacity and safety of the surrounding transportation network as a result of the proposal will be less than minor.

The acoustic assessment submitted as part of the application has provided an assessment as to whether the noise generated by the childcare complies with the ODP standards.

The application is consistent with the relevant performance outcomes and is not contrary to the objectives and policies and assessment criteria of the ODP. The application is consistent with the purpose and principles of the RMA. For the foregoing reasons the application was granted.
