When Does a Garage Need Resource Consent?
A building consent alone covers the construction standards. But if your garage breaches any District Plan rule, you need resource consent first. These are the most common triggers in Hamilton.
- Building within the yard setback (typically 1.5m from side and rear boundaries in residential zones)
- Exceeding the maximum site coverage percentage for your zone
- Breaching the height-to-boundary recession plane
- Building a garage larger than what is permitted as an accessory building
- Placing a garage in a location that blocks required vehicle manoeuvring space
The Setback Trap
The most common issue we see is setbacks. Many homeowners want their garage right on the boundary or close to it. The Hamilton District Plan generally requires a 1.5-metre setback from internal boundaries for accessory buildings, but there are exceptions depending on your zone, the length of the wall, and whether there are windows on the neighbouring property.
If you breach the setback, you need a land use consent. This is not the end of the world. Many are approved, but it adds time and cost. Better to check before you pour the slab.
Costs and Timeframes
If your garage complies with all District Plan rules, you only need a building consent, which typically takes 20 working days. If you need resource consent as well, add another 20 working days and budget for a planning assessment. Getting it right upfront is always cheaper than fixing it after council raises concerns.
